Resolution denouncing the broadcast of obscenity on SRTV

Resolution

WHEREAS, Student Run Television is a service of the Associated Students and funded by the Associated Students; and

WHEREAS, ASUCSD wholeheartedly supports the Principles of Community and is committed to upholding these aspirations, and

WHEREAS, UCSD’s Principles of Community promotes “the open _expression of our individuality and our diversity within the bounds of courtesy, sensitivity, confidentiality, and respect,” and

WHEREAS, A not insignificant percentage of the feedback received regarding the showing of pornographic material has been negative; and

WHEREAS, The ASUCSD is committed to student learning though independent production of television and video, and

WHEREAS, SRTV is an independent unit that is not affiliated with Koala TV except as providing a service to it on an equal basis with every other student organization, and

WHEREAS, ASUCSD sup! ports the principles of freedom of speech, _expression and the press, and

WHEREAS, a precedent has been set by the court case United States v. Young, 465 F.2d 1096, 1098 (9th Cir. 1972) describing obscene material as the stark portrayal of “fellatio, cunnilingus, anal intercourse, sodomy, masturbation, and oral-anal contact,” and the Koala TV programming meets those requirements; and

WHEREAS, the broadcast of obscene material, such as the February 3 episode of Koala TV, even on a closed-circuit station such as SRTV, is a crime; and

WHEREAS, The ASUCSD Council has the power to prohibit further showings of the video and to direct the SRTV Directors to refuse to televise similar productions,

BE IT RESOLOLVED, that ASUCSD finds that the recent programming aired on SRTV known as Koala TV as inappropriate and distasteful,

Further Be It Resolved, that ASUCSD urges all students and s! tudent organizations to express themselves but also to evaluate the impact their actions may have on others and the appropriateness of their actions in our community,

BE IT RESOLVED, that the ASUCSD will take on the following action agenda items:

  • Amendment of the SRTV Broadcast Rules and Regulations to disambiguate the obscenity guidelines,
  • Formation of investigative and judicial procedures to dictate how action will be taken in similar circumstances in the future,
  • Formation of a formalized grievance procedure that will enable students to voice their opinions in a systematic and quantifiable manner,
  • Immediate suspension of the offending program and all similar programming until the above actions are taken.
  • Set a deadline of May 25th, 2005 for the above actions to be taken.

Legislation:

The February 3rd episode of Koala TV, and any other programs containing nudity or explicit sexual content shall be suspended from airing on SRTV until such a t! ime that the articles detailed in Resolution #___ shall be executed to the satisfaction of the AS Council.
